Welcome to Somaluxe. These Terms of Service (“Terms”) govern your access to and use of https://www.somaluxe.com (the “Site”) and any purchases of products offered by Somaluxe (“Somaluxe,” “we,” “us,” or “our”).

By accessing the Site or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Site and purchase products. By using the Site, you represent that you meet these requirements.

2. Products and Descriptions

Somaluxe sells topical skincare products, including peptide and collagen serums and moisturizers. We try to describe products accurately (ingredients, usage, pricing, and imagery). Colors, packaging, and availability may vary. We reserve the right to correct errors, update information, and limit quantities without prior notice.

Cosmetic / FDA disclaimer. Our products are cosmetics for topical use only. They are not drugs and are not intended to diagnose, treat, cure, or prevent any disease. Content on the Site—including product descriptions, testimonials, before/after imagery, and “results” language—is for general informational and marketing purposes and is not medical advice. Individual results vary. Consult a qualified healthcare professional before use if you are pregnant, nursing, have a medical condition, or are taking medication. Statements on the Site have not been evaluated by the U.S. Food and Drug Administration (FDA).

3. Orders, Pricing, and Payment

  • Placing an order is an offer to buy. We may accept or decline any order (including for suspected fraud, errors, or stock issues).
  • Prices are listed in U.S. dollars unless otherwise stated and may change without notice.
  • You agree to provide accurate billing and shipping information and to pay all charges, including applicable taxes and shipping (if any).
  • Payment is processed by third-party providers (WooPayments and PayPal). We may cancel or refuse orders that fail payment verification.

4. Shipping and Delivery

Shipping terms, including any free-shipping offers, are described in our Shipping Policy. Title and risk of loss pass to you upon delivery to the carrier, except where prohibited by law. Delivery estimates are not guarantees.

5. Returns and Refunds

Returns and refunds are governed by our Refunds & Returns Policy. Please review that page before purchasing. Where that policy uses placeholders (for example, return window length), the merchant’s published final version controls.

6. Accounts

If you create an account, you are responsible for keeping login credentials confidential and for activity under your account. Notify us promptly of unauthorized use at the email address on our Contact Us page.

7. Acceptable Use

If you submit reviews, photos, or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and reproduce that content in connection with our business. You represent that you own or have rights to the content and that it is truthful and not misleading.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT PRODUCTS WILL MEET YOUR EXPECTATIONS OR PRODUCE ANY PARTICULAR RESULT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOMALUXE AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR PRODUCTS.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR A PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM IN THE twelve (12) months BEFORE THE CLAIM.

Some jurisdictions do not allow certain limitations; those limitations apply only to the extent allowed.

12. Indemnification

You agree to indemnify and hold harmless Somaluxe and its affiliates from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, violation of these Terms, or infringement of others’ rights.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of the applicable U.S. state where Somaluxe is organized (to be confirmed), without regard to conflict-of-law rules.

Courts in the governing state named above *Option A (simple):* Exclusive venue for disputes is the state or federal courts located in the appropriate county, the governing state, and you consent to personal jurisdiction there. *Option B (arbitration):* Binding individual arbitration in N/A under N/A, with class-action waiver, except for small-claims court where eligible.

Nothing in this section limits consumer rights that cannot be waived under applicable law.

14. Changes

We may update these Terms by posting a revised version on the Site with a new “Last updated” date. Continued use after changes constitutes acceptance, except where additional consent is required by law.
